So, the results are in. Unison took to court in England to gain an injunction in relation to the new Tribunal Costs rules, which come into effect on the 29th of July 2013.
Fox & Partners in Scotland also tried for the same interdict for Scotland, again against the new costs rules.
Either ruling in either parties favour would have seen the legislation on costs to bring a case for a Claimant for the raising of an Employment Tribunal case, brought to a halt.
Neither was successful, at least at present and in their current form. For Scotland, likely in October, it is going to be revisited.
They have already said that if any cases come to pass and are charged, if the ruling goes in their favour, any fees paid would be rebated.
